Kolles says no to van der Garde refund

Force India team boss Colin Kolles has told disgruntled former test driver Giedo van der Garde to make his claim for a $2 million refund in court.

It emerged last month that the Dutch driver, 23, launched legal action against the former Spyker team because he did not do as much test mileage as he had been contractually promised in 2007.

He submitted papers in Holland, but was reportedly told to take the issue to England, where Force India is based.

"This is at least significantly Giedo's fault," Kolles told the Dutch newspaper Algemeen Dagblad.

"Several times we have made attempts to settle the matter amicably," Kolles, 41, added, "but every time our proposals were rejected."

Referring to van der Garde's father-in-law and backer Marcel Boekhoorn, Kolles continued: "He only wants his money back and doesn't want to know about a settlement. Well then, he must go to court in England."

It is understood that the basis of Force India's argument for why van der Garde did not complete his promised 6000 kilometres of testing was the conflicting contract with Super Aguri.

"There was even a claim by Super Aguri against us," Kolles continued, adding that he is not sorry that van der Garde is no longer with the Silverstone based team.

"Simply, he was not good enough, unfortunately," he said.
